This Privacy Policy outlines how WAAFI collects, uses, maintains and discloses your personal data in respect of commercial transactions and how WAAFI safeguards the personal data. Personal Data is information relating to an individual (‘you’ or ‘your’). This Privacy Policy relates to the collection, use and disclosure of personal data, including special or sensitive personal data, by any member of WAAFI.
‘WAAFI’, ‘us’, ‘we’ or ‘our’ in this Privacy Policy refers to WAAFI, including its local and overseas subsidiaries or, as the context may require, any of them.

WAAFI values your privacy and is committed to protecting your personal data. WAAFI will only collect and process your personal data in accordance to the applicable laws.

1. Consent

When you applied or signed up for our Products and/or Services, and your consent is required to process, including to collect, use, record, store, disclose and retain your personal data, you consent for WAAFI to do so in accordance with this Privacy Policy by acknowledging this Policy upon onboarding. WAAFI may process your personal data without your consent in circumstances as permitted by law. 

2. Source and Type of Personal Data Obtained

WAAFI processes the personal data provided by you and/ or a service provider engaged by WAAFI, which is obtained from: 

  • the forms (physical and / or electronic) and supporting documents that you have or may be required to fill / submit for purposes and in connection with your application and subscription to our Products and/or Services; 
  • your utilisation of our Products and/or Services; 
  • your communications with WAAFI through various methods such as emails, social media and letters, telephone calls and conversations you have with WAAFI personnel and/or our authorised agents or partners; 
  • customer surveys that you may take part in or when you sign up for any of our campaigns; 
  • from the public domain and third parties (if any) such as security providers, legal representatives, authorities, statutory bodies or government agencies, credit bureaus or agencies which provide credit or other information (where applicable); and 
  • WAAFI’s related and associated companies and affiliates, service providers, strategic business partners, any other relevant bodies, agencies or partners in connection with our Products and/or Services or such other third parties in any place within or outside Malaysia. 

Personal data which includes but is not limited to the following: 

  • your identity (including sensitive data) may include information concerning your personal detail (including your name, ID number/ passport number/ other identification number or details, birth details, gender, nationality, religion, signature, photo, liveliness video acquired during onboarding); 
  • your contact information (including your telephone number, email address, residential and mailing addresses); 
  • your background (including your employment information);
  • your financial details (including your income, bank account number, financial commitments, credit information, bankruptcy disclosures); and
  • the WAAFI may from time-to-time request for certain other personal information that may be relevant for the WAAFI to consider your request for any other products or banking facility of WAAFI. 

Personal data can also be collected from websites – An IP address is a number that is automatically assigned to your computer when you signed up with an Internet Service Provider. From your IP address, we may identify the general geographic area from which you are accessing our website. When you visit our websites, your IP Address is automatically logged in our server. We may use the IP Address to help diagnose problem and to administer our websites. We do not link your IP address to anything that can enable us to identify you unless it is required by law and regulation. When you visit our website, we may use cookie in some of our pages to store visitor’s preferences and record session information. The information may be collected to ensure greatest service level for our customers.

3. Sensitive information

Depending on your dealings, transactions, or activities with WAAFI, we may also process your sensitive personal data such as your mental or physical health and condition, religious beliefs and misconducts (if required). By acknowledging this Policy, you give us your explicit consent to process your sensitive personal data in accordance with this Personal Data Protection Policy. We may also obtain your sensitive personal information from other parties upon your explicit consent or when it is allowed by law. WAAFI may process your sensitive personal data without your explicit consent in circumstances as permitted by law.

The purposes for which your personal data is collected and processed will vary and may comprise all or any one or more of the following purposes depending on the nature of and the status of the relationship which you have with WAAFI: 

  • evaluation, verifying and processing of your application; 
  • when and where applicable, verifying your current and ongoing financial standing by performing credit reference and credit checks on your credibility and eligibility;
  • for preparation and execution of legal documents and/or instruments in relation to our Products and/or Services; 
  • to assist in your dealings with other organisations (such as takaful company, trustee) in relation to the provision and requirements of the Products and/or Services; 
  • to provide to you and to continue providing to you our Products and/or Services; for verification and security purposes; 
  • to respond to any enquiries and complaints; 
  • for internal checks and functions including statistical analysis and modelling, reporting, compliance, shariah, audit and risk assessment, management and monitoring; 
  • to produce data, reports and statistics which have been anonymised or aggregated in a manner that does not identify you as an individual;

  • contact and communications purposes; 
  • management reporting and to comply with legislative and statutory requirements; 
  • for the investigation of complaints and suspected suspicious transactions;

  • to protect or enforce our rights including to recover any debt owing to us when applicable; 
  • for verification and reference checks by third parties; 
  • general administrative and management purposes; and 
  • for all other purposes in relation or incidental to the above. 

Your information is necessary to us. Unless otherwise stated, all information requested by WAAFI is obligatory. If you do not provide all the obligatory information as requested, we will not be able to keep complete information about you, thus affecting our ability to accomplish the above stated purposes.

5. Disclosure of your information

WAAFI may, subject at all times to any laws (including regulations, standards, guidelines and/or obligations) applicable to WAAFI, disclose your personal data to the following parties (including those within and outside Malaysia): 

  • partners, agents, contractors, vendors and service providers (including but not limited to professional, financial and / or payment service providers) that provide services including data processing services relating to the purposes above; 
  • your agents and advisors (including but not limited to professional advisers) and any other person notified by and authorised by you; 
  • credit bureaus or agencies which provide and collect credit or other information; 
  • government agencies / statutory bodies / authorities; 
  • our business partners and/or other financial institutions in relation to any Products and/or Services and /or any transactions which you conducted or are the subject of; 
  • our assignees or potential assignees, acquirers or potential acquirers and successors-in- title; 
  • any person, who is under a duty of confidentiality who has undertaken the responsibility to keep such data confidential; 
  • WAAFI’s related and associated companies and affiliates (within and outside Malaysia); 
  • announcement on our website and media outlets including social media if you are a winner of any of our campaigns or contests as consented by you (if applicable) and
  • other parties, in respect of whom you have consented to the disclosure of your personal data. 

We may also disclose your personal data (within and outside Malaysia) in good faith, 

  • to comply with requirements of the government, law enforcement agency, any authorities to whom WAAFI is subject to or any orders of court; 
  • as is necessary or relevant in relation to any legal process; or

We take all physical, technical and organisational measures needed to ensure the security and confidentiality of your personal data. If we disclose any of your personal data to our authorised agents or service providers, we will require them to appropriately safeguard the personal data provided to them.

7. Data Retention

We will only retain your personal data for as long as necessary to fulfil the purpose(s) for which it was collected or to comply with legal, regulatory and internal requirements. Afterwards we will destruct or permanently delete your data. 

8. Changes to this Privacy Policy

Please note that we may update this Privacy Policy from time to time. If there are material changes to this Privacy Policy, WAAFI will notify you by posting a notice of such changes on our website or by sending you a notification directly. Do periodically review this Privacy Policy to stay informed on how we are protecting your information. This Privacy Policy was last updated in October 2023.

WAAFI (‘us’, ‘we’, or ‘our’) operates www.waafibank.com (the ‘Site’). This page informs you of our policies regarding the collection, use and disclosure of Personal Information we receive from users of the Site. We use your Personal Information only for providing and improving the Site. By using the Site, you agree to the collection and use of information in accordance with this policy.

While using our Site, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to your name (‘Personal Information’).
