Customer Agreement to the Acceptable Use Policy
Please read this Acceptable Use Policy carefully before you start to use our Site, as this policy will apply to your use of the Site.
The terms ‘WAAFI’, ‘we’, ‘us’ and ‘our’ refer to Waafi Bank Ltd. The terms ‘you’, ‘your’ refer to Customer and User.
By using and/or visiting the Site you agree to this Acceptable Use Policy and Terms and you expressly consent and agree to be bound by this Acceptable Use Policy and Terms and all applicable laws and regulations that govern the Site and the services and/or products offered by WAAFI and/or any group company on the Site which you may avail (the Services).
Use of the Site includes accessing, browsing or registering to use the Site. The policy will be treated as coming into effect on the date you sign up and will continue for an indefinite period until terminated by WAAFI or you.
Terms of Use
When registering for use of the services/site, you must:- Be at least 18 years old.
- Acknowledge and agree that all intellectual property and proprietary rights, and/or all contents and any updates thereof are owned exclusively by WAAFI or members of its Group or the relevant third party vendor and affiliate, as applicable.
Restricted Activities
You may use our Site only for lawful purposes. You may not use our Site:- In any way that breaches any applicable local, national or international law or regulation.
- In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect including but not limited to money laundering, funding of terrorist organisations.
- In any illegal or prohibited products and services or activities including but not limited to narcotics, alcohol, adult services, pornography, weapons or gambling services or any other activities that are prohibited by WAAFI as amended from time to time.
- In Illicit origin of money in any type of transaction.
- For payment made with money from sources, companies or individuals of dubious legitimacy.
- To send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards.
- To transmit, or procure the sending of, any unsolicited, harassing messages or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
- To knowingly transmit any data, send or upload any material that contains viruses, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
- To share any illegal files or data, including infringing, offensive, obscene, threatening, or otherwise unlawful or tortious material.
- To use any material protected by the intellectual property rights of a third party (unless the Customer has the necessary rights to such material).
- To copy, disclose, reproduce or use the confidential information of WAAFI or any third party without permission or otherwise in breach of the customer legal obligations to WAAFI or any third party.
- To misrepresent or impersonate a person or attempt to gain access to or illegally track any other person, Customer, User, account, data, hardware, software, system or network related to the WAAFI Services.
- To distribute unwanted, unsolicited or harassing messages, promotions, advertising, or solicitations.
- For any purpose or activity that harms or disrupts the operation or performance of the WAAFI Services or WAAFI’s Customers, Users, business or operations from time to time.
- To attack, abuse, interfere with, surreptitiously intercept, or disrupt any part of the WAAFI Services (including but not limited to denial of service, unauthorised monitoring or crawling), or otherwise tamper with the security of the WAAFI Services or any Customer, User, account, data, hardware, software, system or network related to the WAAFI Services.
- Whether directly or indirectly to reverse engineer, decompile, disassemble, modify, reproduce or create derivative works of any part of the WAAFI Services.
- For any other activity or purpose that WAAFI deems to be harmful or detrimental to its Customers, Users, business, operations or reputation.
- In any manner not permitted by WAAFI.
Security
- Customer is responsible to maintain the security of the systems in which the Customer uses to connect to the WAAFI Services.
- Customer must ensure that all Users keep any usernames and passwords they use to access the WAAFI Services secure at all times. Users may be required to change their passwords from time to time.
- Customer shall notify WAAFI promptly should Customer become aware of, or reasonably suspect any unauthorised use of or access to the WAAFI Services or unauthorised disclosure of any username or password.
Suspension and Termination
Failure to comply with this Acceptable Use Policy constitutes a material breach of this Policy and Terms, and may result in WAAFI taking all or any of the following actions at its sole discretion with immediate effect.- Immediate, temporary or permanent withdrawal of your right to use the WAAFI Site.
- Issue of a warning to the Customer.
- Legal proceedings against the Customer for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
- Disclose such information to any law enforcement or regulatory authorities as WAAFI considers to be necessary or appropriate.
- To the extent permitted by law, WAAFI excludes and disclaims all liability for actions taken in response to breaches of this Policy. The responses described in this Acceptable Use Policy are not limited, and WAAFI may take any other action it reasonably deems appropriate.
